Terms of Service

1. The agreement

Welcome to Stays. These Terms govern your use of the Stays mobile apps, websites, and APIs (the "Service"). By signing up you confirm that you are at least 18 years old and able to enter into binding agreements under Saudi law.

2. Roles

  • Guests book licensed short-term rentals.
  • Hosts list licensed properties and accept guests.
  • Stays is the marketplace operator. We are not a party to the booking contract between guest and host.

3. Listings & licensing

Hosts may list a property only after submitting valid tourism / Baladi licenses. Stays reviews every listing before it goes live. Stays may refuse, suspend, or remove listings that violate regulations, contain misleading content, or receive serious complaints.

4. Bookings & payments

  • Prices on a listing are inclusive of cleaning fees, service fees, and 15% VAT as displayed at checkout.
  • Payment is collected by Stays at the time of booking via Mada, Apple Pay, STC Pay, Visa/Mastercard, Tabby, or Tamara.
  • Host payouts are released 48 hours after checkout (less the host service fee).
  • Foreign currencies are displayed for convenience only; charges are always in Saudi Riyal (SAR).

5. Cancellations & refunds

Each listing carries one of three policies set by the host:
  • Flexible: full refund up to 24 hours before check-in.
  • Moderate: full refund up to 5 days before check-in.
  • Strict: no refund within 14 days of check-in.
A 5 SAR administrative fee may apply to guest-initiated cancellations as disclosed in the cancellation flow. Stays may waive this fee in extraordinary circumstances at its discretion.

6. Conduct

You agree not to:
  • Use the Service to host or book any illegal activity.
  • Impersonate another person, falsify your identity, or use another user's payment details.
  • Bypass Stays fees or arrange payments off-platform.
  • Post hateful, defamatory, or otherwise harmful content in reviews or messages.
  • Scrape, reverse-engineer, or attack the Service.
Violations may result in suspension, account closure, and referral to law enforcement.

7. Damage & disputes

Stays operates an internal damage protection scheme: guests authorise Stays to charge their payment instrument up to a documented damage amount, in line with the Resolution Center. Disputes are first negotiated peer-to-peer; if unresolved within 7 days, Stays arbitrates based on the evidence each party uploads.

8. Intellectual property

The Stays name, logo, app, and codebase are owned by Stays. The listing content is owned by the host who uploaded it; by uploading it the host grants Stays a worldwide, royalty-free licence to display it on the Service.

9. Liability

Stays provides the Service "as is". To the maximum extent permitted by Saudi law, Stays is not liable for: actions of guests or hosts; loss of profit; or any indirect, incidental, or consequential damages. Nothing here limits liability for fraud, gross negligence, or any liability that cannot be limited by law.

10. Termination

You may close your account at any time (Profile → Delete account). Stays may suspend or close your account if you breach these Terms or if required by law. Outstanding obligations (payments, refunds, damage claims) survive termination.

11. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes will be resolved by the competent Saudi courts unless a binding arbitration agreement is reached.
